  • Credit Cards/Electronic Payments. Credit card and electronic payment information is used solely for payment processing and fraud prevention efforts. Credit card information, and other sensitive personal information required to process a credit decision, is not used for any other purposes by us or our financial services providers, and will not be retained any longer than necessary to provide your services.

12. With Uses and Disclosure of Your Protected Health Information That Do Not Require Your Authorization

Your PHI may be disclosed by our Service Providers, staff, and other employees or affiliates that are involved in your care and treatment services. This disclosure may be related to your treatment, receiving payment for the services rendered to you, and other healthcare operations.

13. Uses and Disclosure of Your Protected Health Information That Do Require Your Authorization

Except in situations as described in Section 13 of this Privacy Policy, we will use and disclosure your PHI only with your written consent, except as permitted by law. In addition, without your written consent we will not sell or use or disclosure your PHI for marketing purposes. Nor will we use your PHI for fundraising or other similar purposes.

In some instances, federal and state legislation may offer specific safeguards for particular types of PHI. To disclose this type of PHI, we require your explicit consent. Should such a situation arise, we will reach out to you to obtain the necessary authorization. Please note that you have the right to withdraw your authorization for specific uses and disclosures of your information at any time. However, this revocation will not apply to any actions we have already undertaken based on the prior consent provided. 14. Your Protected Health Information Rights

Under this Privacy Policy and applicable laws, you have the right to:

  • Request a paper copy of this Privacy Policy;
  • Request restrictions that we limit the way we use or disclose your PHI for treatment, payment, or health care operations;
  • Request that we limit the information we give to a person involved in your care, such as a family or friend. Please note that we are not required to agree to your request except when a restriction has been requested regarding a disclosure to a health plan in situations where the patient has paid for services in full and where the purpose of the disclosure is for payment or healthcare operations. If we do agree, we will honor your limits unless it is an emergency situation;
  • Request that we communicate with you by another reasonable means. For example, if you want to communicate with a different phone number we can usually accommodate that request. However, such request may need to be made in writing as well as require additional verification;
  • Request an electronic or paper copy of your PHI. This request must be in writing and result in a reasonable fee for the cost of producing and mailing the copies. Producing such copies may take thirty (30) days or longer. In certain instances, we may deny your request and will provide the reason for denial. In some instances, you may have the right to request a denial review;
  • Request to amend your PHI that we use to make decisions about you. Your request for an amendment must be in writing and provide the reason for your request. In certain instances, we may deny your request, which will be made in writing. In this event, you may file a written statement of disagreement with us and ask that the statement be included with your PHI;
  • Seek an accounting of certain disclosures by requesting a list of the times we have disclosed your PHI. This request must be in writing and detail the specific information we need in order to honor your request. You may request disclosures made up to six (6) years before your request. You may receive one list per year at no charge. If you request another list during the same year, you may need to pay a reasonable fee. CALIFORNIA PRIVACY RIGHTS NOTICE

Additional Notice for California Residents

This Privacy Notice for California Residents supplements the information contained in the Privacy Policy of PsychiaTreat MNGT LLC, a New York limited liability company (“Company”, ”We”, or “Us”) and applies solely to all visitors, users, and others who reside in the State of California (“Consumers” or “You”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this Notice.

This Policy does not apply to workforce-related personal information collected from Californiabased employees, job applicants, contractors, or similar individuals.

Where noted in this Policy, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B personal information”) from some its requirements.

The CCPA permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are under eighteen (18) years of age, reside in California, and have a registered account with the Website, you have the right to request removal of unwanted data that you publicly post on the Website.   • Deletion Request Rights. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; and
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
4. Exercising Access, Data Portability, and Deletion Rights
  • To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

  • Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period.
  • The verifiable consumer request must:
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request 5 or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.   • Response Timing and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
  • Personal Information Sales Opt-Out and Opt-In Rights. If you are sixteen (16) years of age or older, you have the right to direct us not to sell your personal information at any time (the “Right to Opt-Out”). We do not sell the personal information of consumers we actually know are less than sixteen (16) years of age, unless we receive affirmative authorization (the “Right to Opt-In”) from either the consumer who is at least thirteen (13) but not yet sixteen (16) years of age, or the parent or guardian of a consumer less than thirteen (13) years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back into personal information sales at any time by amending your preferences here.   • In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.
5. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services;
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects.
